Can the meat become a wage for slaughter?

Sacrificial worship is one of the symbols of Islam that has high spiritual and social values. In its implementation, the slaughter of sacrificial animals is a very important part and often involves the services of pejagal or slaughterers. However, in the midst of the community there are many who give part of the sacrificial meat as a wage for these pejagal, thus raising questions for their ability.

This question is not just a technical problem, but touches the legal aspects of fiqh that needs to be studied in depth. In this brief description, the author will discuss the law of making sacrificial meat a wage of pejagal according to the views of the underlying scholars and arguments, as well as solutions to the practice, in order to provide a correct understanding and avoid mistakes in the implementation of sacrificial worship.

About this case there is a related tradition, namely the historical hadith of al-Hakim;

Anyone who has the skin has sacrificed it, then it was not sacrificed to him

“Whoever sells sacrificial animal skins, then it is not sacrifice for him.” (Al-Hakim Clock)

From this hadith the scholars draw conclusions in the form of a prohibition to sell everything from sacrificial animals in the form of meat, fat, horns, hair, skin, and others.[1] Ibn Hajar explained that the animal owned by someone, if sacrificed then came out of his ownership and belongs to the need for the poor, so that it sells it back, including part of robbing the rights of others. More clearly Ibn Hajar said;

It was the sacrifice that came out of his kingdom and walked a poor king, so when he took over him and sold it, he was like Sake

“In fact, with sacrifice, sacrificial animals have come out of their ownership and make them belong to the poor. So if they master it again and sell it, it is like someone who seizes the property of others.”[2]

Now, The same thing according to the scholars is to give something from sacrificial animals as a wage to the slaughtering because it is considered as means by buying and selling.

That he told him that the Prophet ﷺ ordered him to be based on his religion, and that he divided everything, and he would be tied to him, and he did not.

“From Ali bin Abi Talib Ra, the Prophet Muhammad, ordered him to be (watching his sacrificial animals). And he ordered to share all his sacrificial flesh, his skin, and the slowness. And not allowed to give any part of the sacrificial section to the universe.” (Hours. Bukhari 1717)

Ibn Qudamah explained in this book Al-mughni, That this hadith is the foundation of the Bachelor of Prohibition in any part of the sacrifice as a slaughter or slaughter. As for given in charity or gift then it is possible.[5]

Similar is also presented by al-Muhaddits Ibn Hajar al-Asqalani in this book Fathul Bari Fi Syarhi Shahih Al-Bukhari, that giving it as a wage to the slaughter is not allowed because it is transactional, it is different if given in the framework of gifts, alms, or additions to the wages that have been given then the law may. More details he said;

Give prizes for wages is a variety of compensation, and for their gifts, charity, guidance, or for their rights

“Giving (part of the sacrifice) to the butcher as a form of wages is prohibited because it is included in the form of transactions (mu’āwaḍah). As for giving it as alms, gifts, or additions to their rights, then according to qiyas (analogy) the law is allowed.”[6]

From the brief description above, we can conclude that the habits that occur in the community with give part from Sacrifice of sacrifice as a wage for Jaggers or legal massacre cannot.
